Tommy Robinson has rightfully been cleared of terror charges as police took a “discriminatory stance” to question him
Robinson, 42, who’s real names if Stephen Yaxley-Lennon was legally driving a friends car to head to Spain as he regularly does.
Police stopped Robinson at the Channel Tunnel in Folkestone, Westminster Magistrates Court was told.
The police claimed that Robinson gave them so-called “vague replies” over what he was legally doing, then they demanded access to his iPhone then quoting Schedule 7 of the Terrorism Act, which is used for terrorists, Robinson is not and has never been a terrorist.
The Act, when quoted, give the police the power to any person travelling through a UK port “to determine whether they may be involved or concerned in the commission, preparation or instigation of acts of terrorism”.
District Judge Sam Goozee found Robinson not guilty on Tuesday for failing to comply with Schedule 7 of the Terrorism Act.
The judge said, I cannot put out of my mind that it was actually what you stood for and your political beliefs that acted for the principle reason for this stop.”
The judge said at Westminster Magistrates that PC Mitchell Thorogood’s decision to stop Robinson was based on a “protected character,” adding, “I cannot convict you,” which is very embarrassing for Kent Police.
The judge also said he has concerns that the Kent police officers could not remember what they asked Robinson and they were “confused” over the powers that they themselves used to stop him.
Tech billionaire Elon Musk funded Robinson’s legal costs, Robinson thanked the Tesla and SpaceX chief for his support.
Prosecutor Jo Morris opened the case and said that officers “became concerned” over his so-called “demeanour” as he drove into the inspection area.
Morris said that Robinson gave “short, vague replies and made no eye contact.”
Robinson had his phone seized and was taken to an interview room, the court was told.

“It’s my work, I’m a journalist,” and allegedly added that he has information about “vulnerable girls,” Morris said the “process by which journalistic material would be protected was explained to him,” she alleges.
Robinson told the cops during the interview, “For me it’s a win-win, it’s going to be bad for yous.”
Alisdair Williamson KC, defending said Kent Police stopping Robinson was unlawful as the coppers had taken “discriminatory stance” against him.
Williamson said the whole thing was discriminatory as it was based on a significant degree on a protected characteristic” and the “predominant influence” on Pc Mitchell Thorogood’s decision was based on “oh look, it’s Tommy Robinson.”
The Kings Council added, “If MI5 didn’t think that Mr Lennon is a terrorist, what did Pc Thorogood think he was going to learn by asking him about publicly available information?”
Williamson said there is “no evidence that the stop was carried out diligently or expeditiously” the officer was on a “fishing expedition,” to which he failed.
